CONSENSUAL RESOLUTION OF CRIMINAL CASES: THE BRAZILIAN CRIMINAL NON-PROSECUTION AGREEMENT

The purpose of this article is, initially, to make a panoramic exposition on the possibilities of the use of consensual solutions in criminal proceedings, to, later, focus on the Brazilian consensual institute, called the criminal non-prosecution agreement, examining the objective and subjective requirements, established by article 28-A of the Code of Criminal Procedure, also studying the conditions that can be established in that agreement, the need for its judicial approval, as well as the consequences of its fulfillment or breach.
