Abstract

The purpose of this article – in addition to providing a panoramic overview of the current situation of omission – is also to initiate a critical reflection on the effects that the philosophy of language has on the distinction between action and omission in Criminal Law, advocating the dissolution of this difference, as well as defending that omission can have three uses in Criminal Law.

  • Rodrigo Ferreira Leite Cabral Rodrigo Cabral, Cento Universitário Autônomo do Brasil (UniBrasil)

    Doutor em Ciências Jurídicas e Políticas pela Universidad Pablo de Olavide/Espanha. É Promotor de Justiça do Ministério Público do Estado do Paraná. Foi pesquisador-visitante do Max-Planck-Institut para Direito Penal Estrangeiro e Internacional em Freiburg/Alemanha. Professor do PPGD (Mestrado) da UNIBRASIL. Professor Titular do Programa de Doutorado em Ciências Penais da Facultad de Ciencias Jurídicas y Sociales da Universidad San Carlos de Guatemala. Atualmente, é Professor Substituto de Direito Penal da Universidade Federal do Paraná. É, também, Professor da Fundação Escola do Ministério Público do Estado do Paraná (FEMPAR) e da Pós-graduação em Compliance e Direito Anticorrupção do CERS.
