Abstract

O objetivo do presente trabalho é realizar um estudo sobre a liberdade de expressão, na perspectiva conceitual de Robert Alexy, avaliando ser ela um princípio ou uma regra. Para tanto, fruto de uma pesquisa bibliográfica e normativa pertinente ao assunto, será apresentada uma conceituação sobre Direitos Fundamentais, distinguindo o que vem a ser princípio e norma, bem como a liberdade de expressão, apresentando alguns atos normativos brasileiros que tratam do tema. Além disto, serão apresentadas algumas decisões judiciais, particularmente do Supremo Tribunal Federal, do Superior Tribunal de Justiça e de algumas cortes estrangeiras. Por fim, será ressaltado se a liberdade de expressão é um princípio ou uma regra.
