Abstract

Abstract: Brazil is part of the Inter-American System of Human Rights Protection and, consecutively, is a potential contributor to the development of the Latin American Ius Constitucionale Commune (LAICC). Moreover, the 1988 Brazilian Federal Constitution has an opening clause in its 5th article that suggests compatibility with the idea of the Cooperative Constitutional State. In this sense, the question arises: to what extent does a Brazilian cooperative jurisdiction contribute to the strengthening of the LAICC? It is assumed that the development of a cooperative Brazilian jurisdiction can contribute to the strengthening of the LAICC, insofar as it promotes the application of human rights, vertical inter-jurisdictional dialogue, the exercise of conventionality control and the elaboration of protective standards. The purpose of this paper is to demonstrate that the effort towards the materialization of a Brazilian cooperative jurisdiction contributes to the strengthening of the LAICC. The deductive method was employed and the techniques used were bibliographic, documentary and case law research. By promoting the application of international human rights law and the creation of inter-American standards, the development of a Brazilian Cooperative Jurisdiction contributes considerably to the strengthening of ICCLA.
