Data protection and privacy
a perspective on the relationships and distinctions between their rights

Supported by the hypothetical-deductive method, using documentary and bibliographical research, this study investigated the relationships and distinctions between the right to data protection and the right to privacy, proposing a methodology capable of identifying the relationship between the elements that make up each of the rights and their interlocutions. Having examined the concepts and elements of both rights, the hypotheses of distinction and correlations between the rights were analyzed, concluding that there are currents of thought that align with the identification of the right to data protection as a subset contained in the right to privacy and the identification of the right to privacy and the right to data protection as distinct sets with two or more intersecting elements, defending the adequacy of the latter to the detriment of the other.
