Means rea without intentional element and the philosophy of language

In the article "Dolus without intent", Luís Greco abandons the volitive element of dolus, considering it an empirical datum inaccessible to third parties and defines the cognitive element of intent as the author's domain or control over their actions and their possible consequences. However, he contradictorily establishes the mental representation of the high probability of harm as a criterion for correctness. In this article, we use the conceptual tools of the philosophy of language to show that: (i) neither knowledge nor will are psychic phenomena; (ii) control over the causal course is a precondition for the existence of action, and not an element of intent; (iii) there is a conceptual confusion about the uses of the words representation, voluntariness, desire, purpose, and intention; (iv) the theory of Criminal Law is a philosophy, not a science, because its object is the reasons for deciding, not the causes of phenomena. Finally, we propose a fully normative interpretation of the two elements of intent based on the notions of mastery of a technique, language games, and commitment to the production of the outcome.
