This literary review's main objective is to provide a summary of the Austrian legal philosopher's thinking during his studies on the Soviet legal world, at the time of the 30s and 40s of the last century, still with the Union of Soviet Socialist Republics (USSR), which resulted in a small literary work (but with a knowable content of great richness), called “The Communist Theory of Law”, from 1949. This respective work does not result in a criticism of the political-economic system adopted by the USSR at that time, but, rather, in a philosophical – dogmatic work by Hans Kelsen on Law, its characteristics and adaptations to the political – economic needs of that State at that time.
