El Estado de Derecho como principio de protección de los derechos civiles vulnerados

Resumen

Este documento examina la coherencia doctrinal e identifica las discrepancias procesales en la actualización de los elementos clave del Estado de Derecho, como la seguridad jurídica, el acceso a la justicia, la independencia judicial y la protección frente a injerencias arbitrarias. Las conclusiones del estudio revelan que las instituciones judiciales supranacionales respetan sistemáticamente las garantías procesales y proporcionan mecanismos eficaces de protección jurídica. Al mismo tiempo, los tribunales nacionales de Ucrania muestran una aplicación fragmentada de las normas europeas, especialmente en los ámbitos de la aplicación de la ley, la motivación de las decisiones judiciales y la interpretación constitucional. En particular, algunas decisiones del Tribunal Supremo y del Tribunal Constitucional de Ucrania sugieren una alineación gradual con las metodologías del CEDH y del TJUE. Mediante datos empíricos y análisis interjurisdiccionales, el artículo enriquece la comprensión del Estado de Derecho como ideal normativo y como instrumento para la salvaguarda judicial de los derechos civiles. La novedad científica de este estudio reside en una evaluación exhaustiva de la implementación del Estado de Derecho a través de la lente de sus componentes operativos, tal y como los articula la Comisión de Venecia, seguida de su aplicación a casos judiciales concretos en el ámbito de la protección de los derechos civiles.
