POLÍTICAS PÚBLICAS BASEADAS EM EVIDÊNCIAS NA SAÚDE PÚBLICA E ANÁLISE DA JUDICIALIZAÇÃO

Abstract

This article proposes an analysis of public policies based on evidence in public health, also analyzing the importance of this model for the correct performance of both public administration and the Judiciary Branch, in the realization of the right to health. The objective is to explore the application of scientific evidence in the formulation and implementation of public health policies, considering the complexity of the concept of evidence and its multiple dimensions. Firstly, bibliographical research will be used as a methodology, observing the historical development and use of the concept of evidence in public policies, as well as the epistemological assumptions underlying traditional models of understanding social reality, which are the rationalist and constructivist models. The challenges and opportunities of using evidence in policy decision-making will be discussed. Still, the work will analyze the judicialization of public policies in Brazil, pointing out especially how the Federal Supreme Court is attentive to the vision of public policies based on evidence, being essential that judges and law instructor in general understand the main elements of the construction of public policies based on evidence.
