CONSIDERAÇÕES SOBRE A HERMENÊUTICA JURÍDICA DA ESCOLA DA LIVRE INVESTIGAÇÃO EM FRANÇOIS GÉNY
Abstract
O artigo apresenta como tema a hermenêutica jurídica da Escola da Livre Investigação, com destaque para o pensamento de seu maior defensor: François Gény. Para contextualizar o tema, será apresentado breve histórico sobre algumas das principais escolas hermenêuticas do Direito para em seguida abordar, mais especificamente, a Escola da Livre Investigação. A obra de François Gény terá tópico específico no presente artigo. Serão apresentadas suas principais posições teóricas e elaboradas algumas considerações a seu respeito, com base em estudiosos que analisaram o tema. Busca-se com o presente ensaio relacionar a teoria interpretativa de Gény com discussões contemporâneas para se demonstrar que seu pensamento ainda pode ser encontrado na atualidade.Downloads
