Agências regulatórias e grupos de interesse: uma explicação através da teoria do estado-fato de Léon Duguit e da teoria econômica da regulação de George J. Stigler
Abstract
O artigo analisa os regulamentos expedidos pela Agência Nacional de Telecomunicações - ANATEL relacionados à internet fixa, em especial a questão da limitação do serviço. O trabalho tem como marco teórico a aplicação em conjunto da teoria econômica da regulação de George Stigler, também conhecida como captura, com a teoria do Estado-fato de Léon Duguit. O objetivo é compreender a dinâmica dos grupos de interesse durante a elaboração desta política regulatória pela ANATEL e como os reguladores são capturados pelos entes regulados A justificativa da pesquisa é a atualidade do tema e a necessidade dos operadores do direito de compreender a dinâmica regulatória das Agências Reguladoras.Downloads
