The role of international judicial and arbitral institutions in shaping convergent approaches to investment dispute resolution

The aim of the study is to assess the role of international judicial and arbitration institutions in shaping convergent approaches to the resolution of investment disputes. The research methodology is based on the use of a panel econometric model to assess the impact of institutional factors on the standardization of legal approaches. The dependent variable is the Investment Dispute Resolution Standardization Index. The independent variables include the institutional authority of arbitration bodies, the intensity of the use of legal precedents, the level of harmonization of investment treaties, and the institutional diversity of arbitration forums. The empirical background of the study covers the period 2020–2025 and includes seven countries: Ukraine, Germany, the United Kingdom (UK), Poland, Turkey, China, and the United States. The results of the econometric analysis confirm the statistically significant impact of institutional factors on the standardization of international investment arbitration. International arbitration institutions contribute to the harmonization of legal approaches between different jurisdictions, as states apply different legal systems and treaty regimes. The obtained results indicate increasing convergence of legal approaches to investment dispute resolution within the analysed jurisdictions.
