Análisis de la eficacia de los mecanismos de ejecución de las resoluciones judiciales en el sistema de justicia civil de Ucrania

El objetivo de este estudio es descubrir la eficacia de dos mecanismos existentes para la ejecución de decisiones judiciales en procesos cívicos en Ucrania. Una metodología de investigación se basa en los índices de desarrollo del sistema judicial: el índice de eficacia de la justicia elaborado por el Banco Mundial y los indicadores de calidad de la regulación y del Estado de derecho. La calidad de la regulación es medida en una escala de -2,5 a +2,5, ya que los valores positivos indican mayor eficacia. Com base em dados do Banco Mundial e da Administração Judiciária Estatal da Ucrânia, foi realizó uma análise de correlação-regressão. Los resultados obtenidos demuestran que el aumento del índice de Estado de Derecho y la calidad de la regulación tienen un impacto positivo estadísticamente significativo en la eficacia de la ejecución de las decisiones judiciales (R² = 0,79). Constatou-se que existen dificultades en el funcionamiento del mecanismo del sistema de justicia civil de Ucrania, devido al bajo porcentaje de ejecución efectiva. Como conclusiones indican que, para solucionar los problemas presentados, se propone optimizar la legislación, establecer la disciplina disciplinaria y implementar un banco de datos automatizado para la ejecución de las decisiones.
