A FALÁCIA DA ISONOMIA ENTRE AS PARTES NO PROCESSO PENAL BRASILEIRO: QUANDO A ESTRUTURAÇÃO MATERIAL E ORÇAMENTÁRIA IMPORTA!
THE FALLACY OF ISONOMY BETWEEN THE PARTIES IN THE BRAZILIAN CRIMINAL PROCEDURE: WHEN THE MATERIAL AND BUDGETARY STRUCTURE MATTERS!

Based on a bibliographical review and document analysis of the 2023 Brazilian Federal Annual Budget Law, this study sought to understand: what is the extent of isonomy of the parties according to the constitutional mandament of ample defense in favor of procedural subjects and to what extent the Brazilian State preserves and fulfills the individual rights and guarantees of access for all people to the legal system at all levels, judicial or extrajudicial, but especially in the investigative phase, or pretrial, of the criminal process? These questions with a focus on the Criminal Procedure and the (un)effective participation of the citizens in the preliminary investigation will allow us to understand an important point of maintainance of the inquisitorial mentality in the Brazilian criminal procedural system as a deliberate public policy, which is the lack of adequate implementation of the Public Defender's Office in the States and in the Union, reinforced by the repetition, affronting the Constitution, that the ample defense could be mitigated in the preliminary investigation.
