Cooperación Judicial Penal en la UE, Iuspluralismo y Derechos Fundamentales. Una descompasada melodía.
Abstract
Con el presente artículo se pretende realizar una pequeña aproximación a cómo se conjugan los instrumentos cooperatorios en la UE y cuál debería ser su polifonía jurídica. Se abordará el mismo con una breve introducción histórica con carácter pluridimensional y multidisciplinar, de manera que permita entender esa nueva realidad, conocer las sinergias jurídicas, tensiones y distorsiones que se producen en el ámbito de la cooperación judicial penal en la UE[1]. Para ello se hará necesario, siquiera sea de soslayo, introducirse en el alocado diálogo jurídico habido, por un lado, entre UE y EM y, por otro, entre éstos y los tribunales nacionales y supranacionales.
