Aplicação da justiça restaurativa: uma análise da experiência luso-brasileira
Abstract
A experiência recente demonstra que o sistema penal retributivo
classicamente adotado não está mais conseguindo alcançar os objetivos que
propunha, de modo que mesmo as penas mais severas não se mostram mais
capazes de coibir a prática de crimes. O presente trabalho visa apresentar a
evolução da aplicação da Justiça Restaurativa no trato de casos envolvendo
condutas danosas e notadamente ilícitas no âmbito do sistema de Portugal e do
Brasil. Conclui-se, portanto, pela eficácia geral das práticas restaurativas, ainda que
suas aplicações sofram variações de acordo com o projeto e sistema jurídico no
qual estejam inseridas.
