Variáveis estruturais internas e externas da participação do Brasil no regime internacional das mudanças climáticas – uma análise empírica transversal entre o direito e relações internacionais
Abstract
A hipótese principal do trabalho é a de que no caso do regime internacional do clima a grande polaridade das variáveis internas e a baixa polaridade das variáveis externas em torno do tema criaram incentivos para que o Brasil pudesse participar como protagonista do regime, adotando assim um purposive behavior (SCHELLING, 2006) no cenário internacional que o coloca como um interlocutor privilegiado dos países do Global South com o Norte desenvolvido.
Como hipótese secundária, inferimos que este ambiente político interno e externo faz com que o relacionamento do direito internacional com o direito interno ocorra com relativa sincronia, o que não ocorre em outros regimes internacionais que o Brasil não é protagonista. Espera-se comprovar empiricamente esta inferência a partir de uma estratégia metodológica que consiste em primeiro promover uma análise das obrigações internacionais assumidas pelo Brasil quanto às mudanças climáticas vis-à-vis suas implicações no direito interno, para que em seguida se compare a participação no regime das mudanças climáticas com sua participação em outros regimes ambientais.
