O estabelecimento da filiação e a Constituição da República Portuguesa – alguns pontos de discussão
Abstract
Por vezes, quando falha a colaboração dos progenitores, o estabelecimento da filiação poderá ser forçado e tal pode vir a contender com algumas questões constitucionais. Nestes casos, apesar do superior interesse do filho em ver os seus laços estabelecidos, existem limites constitucionais que devem ser respeitados. Todavia, nem todos os países adotam a mesma bitola nestes casos. Importará discutir quais os direitos constitucionais em confronto nos casos do estabelecimento da progenitura biológica e quais as soluções a que a doutrina e jurisprudência têm chegado.Downloads
