Estado de vigilância

Resumen

A “revolução” da tecnologia da informação tem produzido reflexos em todos os domínios da existência humana. Prenuncia-se a emergência de uma nova sociedade do mundo digital e pós-alfabético. As ambivalências desse prenúncio e sociedade ainda não foram adequadamente compreendidas pela epistemologia, menos ainda pelo Direito. Na novidade o que se tem de certo é o velho instrumento de controle: a vigilância. A economia é cada vez mais uma economia de vigilância. O Estado, antigo protagonista da técnica de vigia, é cada vez mais também um Estado de vigilância. As comodidades da vida são o argumento da economia. A “pax social”, a promessa desse velho novo Estado. O constitucionalismo da Modernidade e suas garantias parecem uma arqueologia da política e do Direito. Em seu lugar, instaura-se um constitucionalismo da concórdia civil, em última instância, do mercado.
