REFORMING LATIN AMERICAN CRIMINAL JUSTICE SYSTEMS: ACCUSATORY MODELS, NEOLIBERAL RATIONALE?

Resumen

el neoliberalismo es un tipo de racionalidad, mucho más que una forma económica o política. La principal diferencia respecto el liberalismo clásico es su forma de intervención, que ocurre a través de derecho. A partir de la década de 1990, una serie de reformas han sido dirigidas a la América Latina, especialmente la reforma del Judiciario. Organismos como USAID, Banco Mundial y Banco Interamericano de Desarrollo han financiado dichas reformas. Una de las principales reformas ha sido las reformas procesales penales, que han introducido formas negociales. Sin embargo, estas reformas han producido, a lo largo, incremento de la población carcelaria y también el aumento de la discrecionalidad del Ministerio Fiscal. A pesar de referidas como acusatorias, tales reformas han producido resultados que han deformado los procedimientos procesales penales y que funcionan exclusivamente desde una lógica neoliberal.
