O ESTADO SOCIAL E OS DIREITOS SOCIAIS- UM NOVO PARADIGMA? SOCIAL STATE AND SOCIAL RIGHTS - A NEW PARADIGM?

Resumen

 

RESUMO: O ideal do Estado Social só surgiu com o final da II Grande Guerra, portanto, nos anos 50 do século XX. Ideal esse que foi resultado das consequências das duas grandes guerras e pela situação dos Estados nesse contexto. Com a mudança de paradigma, de um Estado abstencionista para um Estado intervencionista as Constituições passaram também a consagrar uma nova geração de Direitos fundamentais, os Direitos sociais em sentido amplo, que exigem a intervenção do Estado para se efetivarem, que de um modo geral constam de normas programáticas, não exequíveis por si mesmas.

Após o avanço histórico de consagração de direitos sociais nos textos constitucionais, deparamos no século XXI com um contexto generalizado de crise económica e social na Europa em que os Estados têm dificuldade em cumprir as regras fixadas nas suas Constituições e satisfazer o respeito pelos Direitos sociais.

Atendendo ao texto da Constituição da República Portuguesa de 1976 (CRP) e à atuação do Tribunal Constitucional português, foca-se a atenção na vivência feita dos direitos sociais, sem esquecer a menção aos textos europeus mais relevantes, com especial atenção para a relevância jurídica da Carta dos Direitos Fundamentais da União Europeia, após a entrada em vigor do Tratado de Lisboa, e sua presença na jurisprudência do Tribunal de Justiça da União Europeia.

ABSTRACT: The ideal of the welfare state only came up with the end of World War II, so in the 50s of the twentieth century. Ideal one that was a result of the consequences of two world wars and the situation of the States in this context. With the paradigm shift, an abstentionist state to an interventionist state constitutions also came to consecrate a new generation of Fundamental rights, social rights in the broad sense, requiring state intervention to take place, which generally contained programmatic standards, not achievable for themselves.
After the historic breakthrough social rights consecrated in constitutional texts, faced in the twenty-first century with a general context of economic and social crisis in Europe that states have difficulty complying with the rules laid down in their constitutions and meet respect for social rights.
Given the text of the Portuguese Constitution of 1976 (CRP) and the actions of the Portuguese Constitutional Court, the attention focuses on the experience made of social rights, not forgetting to mention the most relevant European texts, with special attention to the legal significance of the EU Charter of Fundamental Rights, after the entry into force of the Treaty of Lisbon, and their presence in the Court of Justice of the European Union.
